Appearing via video, 38-year-old Rep. LaMonica McIver was read her rights before being released on her own recognizance. She faces up to eight years in prison if convicted, according to the New York Post.

The prosecution of McIver is a rare federal criminal case against a sitting member of Congress for allegations other than fraud or corruption.

The Justice Department also announced it would be dropping the misdemeanor trespassing charge against Newark Mayor Ras Baraka.
