Idaho’s Republican-dominated state House of Representatives voted 46-24 Monday to pass a resolution to reject same-sex marriage, despite the U.S. Supreme Court’s 2015 landmark ruling in Obergefell v Hodges.

A state legislative committee has advanced a resolution asking that the power to regulate marriage be returned to the states.

The Idaho House of Representatives on Monday called for the U.S. Supreme Court to reverse the 2015 ruling that extended the fundamental right of marriage to same-sex couples. On Monday, the Idaho House voted 46-24 to pass House Joint Memorial 1.

In 2006, Idaho voters passed an amendment to the state Constitution to define marriage as a union between a man and a woman, though the Supreme Court’s ruling nearly a decade later found that such laws violate the 14th Amendment’s equal protection and due process guarantees.

Idaho lawmakers are introducing a flurry of legislation this session, including a memorial asking the U.S. Supreme Court to allow states to make their own decisions over how marriage should be defined.
